National chicken council wants gipsa rules withdrawn

USDA_GIPSA_logoThe Nation’s Chicken Council filed comments using the U.S. Department of Agriculture’s Grain Inspection, Packers, and Stockyards Administration that described why the interim and final rules suggested can be harmful for his or her industry. The NCC calls the guidelines “ill-advised,” saying they’d cost American agriculture vast amounts of dollars in economic damage, exceed GIPSA’s authority, and represent a random abuse of federal authority. NCC President Mike Brown states within the comments that GIPSA unsuccessful to supply any justification for that sweeping rule changes forced upon the chicken industry. “GIPSA doesn’t explain what benefits would counterbalance the vast amounts of dollars in harm this makes the American economy,” Brown states. “The agency also fails to take into consideration the negative impact on consumers, innovation, competition, as well as food safety.” Brown states his organization is especially worried about a possible storm of litigation that could derive from the brand new rules. He states the brand new rules appear made to create uncertainty and litigation, stating that even GIPSA admits pricey litigation will ensue. Eight different Courts of Appeals have rejected a vital area of the new rules which say a litigant will have to prove competitive injuries to show a breach.
